Even though Japaneselaw does not distinguish between law and equity, the civil law tradition has afunction like equity, such as the “principle of good faith.”\nUnder the Japanese Civil Code, “contracts” include fiduciary relationships.Since the “due care of a prudent manager” (the Civil Code Article 644) includesnot only duty of care but also duty of loyalty, it plays a role like fiduciary duty.\nFiduciary duty has the function of defining the protection range under the Japanese privacy law.
