| 内容記述 | This article discusses the usefulness of fiduciary duty in protecting privacy.Fiduciary duty derives from the common law tradition. Even though Japaneselaw does not distinguish between law and equity, the civil law tradition has afunction like equity, such as the “principle of good faith.” Under the Japanese Civil Code, “contracts” include fiduciary relationships.Since the “due care of a prudent manager” (the Civil Code Article 644) includesnot only duty of care but also duty of loyalty, it plays a role like fiduciary duty. Fiduciary duty has the function of defining the protection range under the Japanese privacy law. This can be derived by considering the obligations of the Act on the Protection of Personal Information. |
